1. Agreement to Terms
By accessing or using Mailat's managed email platform service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms apply to all users of the Service, including customers, visitors, and administrators.
2. Description of Service
Mailat provides a managed email platform that includes:
- Dedicated server provisioning on Hetzner infrastructure
- Email server software installation and configuration
- Integration with your AWS SES credentials for email delivery
- Server management, monitoring, and updates
- Customer support based on your subscription plan
3. Account Registration
3.1 Eligibility
You must be at least 18 years old and capable of entering into a legally binding agreement to use this Service.
3.2 Account Security
You are responsible for:
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
4. Subscription and Payment
4.1 Subscription Plans
We offer the following subscription plans:
- Regular ($10/month): 2 vCPU, 4GB RAM, 5 email domains
- Dedicated ($19/month): 4 vCPU, 8GB RAM, 20 email domains
- Enterprise ($50/month): 8 vCPU, 16GB RAM, unlimited domains, custom domain
4.2 Billing
- Payments are processed through Gumroad
- Subscriptions are billed monthly or quarterly in advance
- Prices are in USD and exclude applicable taxes
4.3 Refunds
We offer refunds under the following conditions:
- Within 7 days of initial purchase if the service does not meet your requirements
- Pro-rated refunds are not provided for mid-cycle cancellations
- Refund requests should be submitted through Gumroad or our support system
5. Acceptable Use
5.1 Permitted Use
You may use the Service for lawful email communication purposes only.
5.2 Prohibited Activities
You agree NOT to use the Service to:
- Send unsolicited bulk email (spam)
- Send emails that violate CAN-SPAM, GDPR, or other applicable laws
- Distribute malware, viruses, or malicious content
- Engage in phishing or fraudulent activities
- Harass, threaten, or defame others
- Infringe on intellectual property rights
- Attempt to gain unauthorized access to systems
- Resell or sublicense the Service without permission
5.3 Email Sending Requirements
When sending email through the Service, you must:
- Have consent from recipients (opt-in)
- Include accurate sender information
- Provide a working unsubscribe mechanism
- Honor unsubscribe requests promptly
- Comply with AWS SES Acceptable Use Policy
6. AWS Credentials
You are responsible for:
- Providing valid AWS credentials with appropriate SES permissions
- Ensuring your AWS account is out of sandbox mode
- Any charges incurred on your AWS account for email sending
- Maintaining your AWS SES sending reputation
7. Service Level Agreement
7.1 Uptime Commitment
- Regular/Dedicated: Best effort, no SLA
- Enterprise: 99.9% uptime guarantee
7.2 Support Response Times
- Regular: 48 hours
- Dedicated: 24 hours
- Enterprise: 4 hours
7.3 Maintenance
We may perform scheduled maintenance with advance notice. Emergency maintenance may be performed without notice to address security or stability issues.
8. Data and Privacy
8.1 Your Data
You retain ownership of all email content and data stored on your dedicated server. We do not access your email content except as necessary for:
- Providing technical support when explicitly requested
- Automated system maintenance and updates
- Responding to valid legal requests
8.2 Backups
Automated backups are provided based on your plan. You are responsible for verifying backup integrity and maintaining additional backups if needed.
8.3 Privacy
Our collection and use of personal information is governed by our Privacy Policy.
9. Intellectual Property
The Service, including its software, design, and documentation, is owned by Mailat and protected by intellectual property laws. You are granted a limited, non-exclusive license to use the Service for its intended purpose.
10. Termination
10.1 By You
You may cancel your subscription at any time through Gumroad. Your service will remain active until the end of the current billing period.
10.2 By Us
We may suspend or terminate your account immediately if:
- You violate these Terms or the Acceptable Use Policy
- Your payment fails and is not resolved within 14 days
- Required by law or legal process
- Your activities harm other users or our infrastructure
10.3 Effect of Termination
- Access to the dashboard is revoked immediately
- Server remains accessible for data export during grace period (7 days)
- Server and data are permanently deleted after grace period
- No refund for the current billing period
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAILAT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless Mailat from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
14. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or dashboard notification at least 30 days in advance. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
15. Governing Law
These Terms are governed by the laws of the jurisdiction in which Mailat is incorporated, without regard to conflict of law principles.
16. Dispute Resolution
Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration.
17. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and Mailat.
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
- Waiver: Failure to enforce any right does not waive that right.
- Assignment: You may not assign your rights under these Terms without our consent.
